Case Result: Hague Convention Petition Denied – Child Abduction Allegation Dismissed

Immigration attorney Devon Senges was ecstatic to receive news last week that one of her cases from over 2 years ago was finally resolved in our client’s favor.

The case was a heart-wrenching case involving an allegation of international child abduction (kidnapping) and domestic violence. It all started when the father of the child contacted the U.S. Department of State to make child abduction allegations against our client. He claimed our client took their child out of Honduras without his consent, and he wanted the child returned to him. However, there was more to the story than he led on.

Child Abduction Allegation Dismissed

The Hague Convention

Because the father had contacted the U.S. Department of State and had made an international kidnapping allegation, this case was subject to rules under the Hague Convention. The Hague Convention, or Hague Abduction Convention, is an international treaty signed by over 100 countries. These countries have agreed to work together to help return children to their home country after being illegally abducted or retained in another country.

Factors considered under the Hague Convention include:

  • Habitual residence of the child
  • The parent’s custody rights
  • The aggrieved parents exercise of his/her custody rights
  • The age of the child

Returning the Child Would Put the Child at Grave Risk

Attorney Devon Senges did not contest the child abduction allegations against our client. However, she did argue that returning the child would put the child at grave risk of harm. Therefore, she asserted the petition should be denied.

The risk of harm was based on many allegations, mainly the father’s extremely troubling testimony under cross-examination which attorney Devon Senges conducted. His testimony illustrated his very misogynistic view of women and teenage girls. He even admitted he would not sufficiently protect his daughter from sexual abuse or sexual predators, that he would even condone it.

The court specifically noted that the father himself was a sexual predator given that he lured our client into a sexual relationship as a 20-year-old man. He then impregnated her with the child at issue – all while our client was only 13 years old. In his testimony, when regarding his own daughter, he admitted he would allow or condone the same thing to happen to her.

Victory and Safety for our Client and her Child

Ultimately, the federal judge agreed with Devon that there was clear and convincing evidence that the child would be at grave risk if returned to Honduras. This was such a great victory and such a relief for our client! After two years, our client can finally look forward to her child’s future here in the United States under her care.

Alegación de secuestro de niños descartada

La abogada de inmigración Devon Senges estaba emocionada al recibir la semana pasada la noticia de que uno de sus casos de hace más de 2 años fue finalmente resuelto a favor de nuestro cliente.

El caso era un caso desgarrador que involucraba una acusación de secuestro internacional de una niña y violencia doméstica. Todo comenzó cuando el padre de la niña se puso en contacto con el Departamento de Estado de EE.UU. para hacer alegaciones de secuestro contra nuestro cliente. Afirmaba que nuestro cliente había sacado a su hija de Honduras sin su consentimiento y que quería que se la devolvieran. Sin embargo, había más en la historia de lo que él contaba.

La Convención de La Haya

Dado que el padre se había puesto en contacto con el Departamento de Estado de EE.UU. y había presentado una denuncia de secuestro internacional, este caso estaba sujeto a las normas de la Convención de La Haya. La Convención de La Haya, o Convención de La Haya sobre Secuestro, es un tratado internacional firmado por más de 100 países. La devolución de la niña pondría a la niña en grave riesgo

La abogada Devon Senges no impugnó las acusaciones de secuestro de menores contra nuestro cliente. Sin embargo, argumentó que la devolución de la menor pondría a la niña en grave riesgo de sufrir daños. Por lo tanto, afirmó que la petición debía ser denegada.

El riesgo de daño se basaba en muchas alegaciones, principalmente el testimonio extremadamente preocupante del padre en el interrogatorio que realizó la abogada Devon Senges. Su testimonio ilustró su visión muy misógina de las mujeres y las adolescentes. Incluso admitió que no protegería suficientemente a su hija de los abusos sexuales o de los depredadores sexuales, que incluso los aprobaría.

Finalmente, el juez federal estuvo de acuerdo con Devon en que había pruebas claras y convincentes de que la niña estaría en grave riesgo si se la devolvía a Honduras. Esta fue una gran victoria y un gran alivio para nuestra cliente. Después de dos años, nuestra cliente puede finalmente mirar hacia el futuro de su hija aquí en los Estados Unidos bajo su cuidado.
