What is DACA?

Deferred Action for Childhood Arrivals, also known as DACA, is an immigration policy that allows those who were brought to the United States as children to apply for a 2-year period of deferred action. During this renewable 2-year period, DACA holders do not have to fear deportation as they are temporarily protected from removal proceedings. Through this immigration policy they also receive a work permit so that they can legally work in the United States. However, this program does not grant legal status.

What are the Qualification Requirements for DACA?

To apply for the Deferred Action for Childhood Arrivals program you need to meet the following requirements.

  1. You were under the age of 31 as of June 15, 2012;
  2. You came to the United States before reaching your 16th birthday;
  3. You have continuously resided in the United States since June 15, 2007, up to the present time;
  4. You were physically present in the United States on June 15, 2012, and at the time of making your request for consideration of deferred action with USCIS;
  5. You had no lawful status on June 15, 2012;
  6. You are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  7. You have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.

What is the Current Status of DACA?

Unfortunately, the White House and the Courts are in a battle over the legality of DACA. As of July 29, 2020, two separate courts including the Supreme Court of the United States have ordered the government to accept new DACA applications. However, the government refuses to comply and continues to play games with the lives and futures of millions of deserving young people and families.
